Jeremy Oliver, prosecuting, said: "David Davies, Danielle Upton and Richard Martin had been out in Park Street and decided to go and get some food. The defendant appeared wearing just fishnet stockings and a T-shirt and carrying a handbag. When he was challenged about the way he was exposing himself he started shouting and being threatening. He said he would 'stab them up' and told Mr Davies to put 'your dog on a leash' – referring to Miss Upton.

The defendant repeated threats of stabbing people over several minutes. The friends left and Mr Davies phoned police while McInerney remained inside. "McInerney came outside and continued being aggressive and tried to provoke Mr Davies into a fight." He added that CCTV footage shows the defendant waving his private parts around. He added that McInerney had no previous convictions.
Will Palmer, defending, said: "My client is an idiot – and on the night in question he was a drunken idiot. He went on a big night out with his friends and they thought it would be funny to strip him of his clothes." He said that his client was in fact assaulted twice by Miss Upton during the incident. "At no point did he raise his fist or throw a punch but he was loud and unpleasant." Unemployed McInerney, was fined £100, must pay a £15 victim surcharge and ordered to pay £85 costs.
